1. GENERAL RETURNS OF GOODS

1.1. This Regulation determines the actions of the parties to return the Goods (hereinafter also referred to as “detail / parts”) purchased by the Buyer, and is an integral part of the supply agreement (Appendix No. 1). The return of the Goods is possible only in the manner and on the conditions stipulated by this Regulation. Cases of deviation from the rules of this Regulation are possible only by agreement between the Supplier and the Buyer, drawn up in writing.

1.2. A prerequisite for the return of the Goods for any of the reasons is the integrity and cleanliness of the containers and / or packaging of the Goods in the form in which they were initially upon receipt of the Goods, as well as the presence of a sticker (branded sticker with a trademark, service mark) of the Supplier on the packaging or directly on the Product itself. If, upon returning, the Supplier reveals a broken, damaged, contaminated package or its absence, he has the right to refuse the Buyer to return the Goods.

1.3. The Supplier reserves the right to change the conditions for the return of the Goods, about which he is obliged to notify the Buyer by any available means of communication at least 14 (fourteen) calendar days prior to the date the changes become effective. Changes in the conditions for the return of the Goods apply to the Goods purchased by the Buyer after their entry into force.

1.4. If the Buyer is not in the city of Lipetsk, the transportation of the Goods from the Buyer to the Supplier upon return is carried out by the Buyer,

2. TERMS OF RETURN OF GOODS IN DIFFERENCE IN QUANTITY, ASSORTMENT, COMPLETENESS AND VISIBLE DEFECTS

2.1. The rules of this section apply to cases of violation by the Supplier of the terms of the agreement on the quantity, range, completeness and quality (in terms of visible defects) of the delivered Goods: the goods are delivered in excess of the ordered; goods that do not correspond to the ordered assortment items; incomplete goods; defective product.

In these cases, among other things, the return of the Goods is made that clearly does not correspond to the ordered serial (catalog) number (while the received Goods with the corresponding serial (catalog) number is not an agreed replacement for the previously ordered one), with the confused sides of the right / left installation, broken, broken Product (in this case, such Product is not subject to sale to the end consumer and installation on a vehicle).

2.2. If the Buyer identifies the delivered Goods with other serial (catalog) numbers, the Buyer must make sure that the serial (catalog) part number does not correspond to the order before returning the Goods. If the Supplier establishes the fact of delivery of the Goods with correct serial (catalog) numbers, the Goods will not be accepted for return and must be sent to the Buyer’s address at his expense.

2.3. The rules of this section do not apply to cases of replacement of serial (catalog) numbers and / or manufacturer for Products with similar functional purpose, when such replacements are provided for by the current rules for shipment of parts from warehouses of foreign suppliers.

In these cases:

  • return, exchange of the Goods, refund of funds to the Buyer is not made;
  • at the discretion of the Supplier and in agreement with him, it is possible to provide the Buyer with a discount for the shipped Goods or for the Goods in the following (next) batches.

2.4. Goods (body sheet parts) that have minor flaws, corrected (eliminated, restored) during the preparation of the part for installation on a vehicle or do not affect the consumer properties of the Goods, are not subject to return and / or exchange and remain with the Buyer. Such shortcomings, among other things, include scuffs, scratches and other damage to plastic and metal body parts intended for painting, as well as shortcomings of all other types of Goods that can be corrected during further installation on a vehicle that do not affect the consumer properties of the Goods. …

In these cases:

  • return, exchange of the Goods, refund of funds to the Buyer is not made;
  • at the discretion of the Supplier, in exceptional cases and in agreement with him, it is possible to provide the Buyer with a discount for the shipped Goods or for the Goods in the following (next) lots.

2.5. Long-length goods – over 1 (one) meter in length – such as moldings, thresholds, gutters, seals, brake pipes, etc. are to be delivered to the Buyer in the condition in which they arrived at the Supplier from the warehouse of a foreign supplier.

2.6. Acceptance of the Goods in terms of quantity, assortment, completeness and visible (obvious) deficiencies is carried out immediately at the time of inspection and transfer of the goods from the Supplier (representative of the Supplier) to the Buyer before signing the universal transfer document.
